The death took place on Wednesday last at the residence of her Daughter ( Mrs Wain) Brunswick, of Mrs Lynch widow of the late Mr. D. Lynch, of Hutton St Kyneton. Mrs Lynch who was 75 years of age at the time of her death, was a native of Co. Tipperary, Ireland and was a daughter of the late Mr. Frisby of that place. She came to Victoria early in life, and was a resident of Kyneton for more than 50 years. About 10 months ago, shortly after the death of her husband, she left Kyneton and from then until the time of her death she resided with her daughter at Brunswick. Mrs Lynch was possessed of a genial and generous disposition, and her death will be heard of with regret by all who knew her in the town and district. She is survived by her daughter (Mrs. Wain) and two sisters - Mrs. Sheedy, of Gippsland, and Mrs COrdell, od Tasmania. The interment took place in the Kyneton Cemetery on Thursday, the body being brought from Melbourne by the afternoon train. Rev. Father McCarthy officiated at the grave. Mr. J. The date of birth was stated as 27May 1822 for the issue of a seamen's ticket at Padstow in 1846 but his place in the family and the year of his baptism suggests 1823 as more likely..1,2 Thomas was issued a seaman's ticket for employment as a carpenter in the merchant navy at Padstow, Cornwall, England, on 23 April 1846. His height was 5'7 3/4' and it was noted that he was born in Padstow.3

He married Elizabeth Ann Vicary on 9 September 1848 at in the parish church, Stoke Damerel, Devon, England. Thomas was a shipwright aged 25 and his father was Thomas Withell builder. This identifies him as being the son of Thomas Withell and Ann Kay of Padstow. The witnesses to the marriage were Charles Vicary and John Symons. At the time of his marriage Thomas was living at 4 Moriac Street and Elizabeth was living at 13 Portland PlaceM Cert ..4

The story of this marriage is a very short and sad one because it seems that Thomas was already suffering from Phthisis. Their son Charles was born during the December Qr. of 1848 and died on 4 May 1849.

Thomas died at age 26 of Phthisis on 19 June 1849 at 13 Portland Place, Stoke Damerel. This was where his wife Elizabeth Ann Vicary had been living at the time of their marriage. The witness to the death was Elizabeth Rogers. However it was to be less than 3 months before Elizabeth Withell also died. in Stoke Damerel.5

Florence Annie Jory

     Florence was born say 1873. She married Charles Frederick Withell on 24 April 1906 at St Augustine, Plymouth, Devon, England.1,2 She made a will on 15 November 1944 at Plymouth, Devon, England. Florence made two initial legacies. Dorothy Easton was to receive 50 pounds and the remainder was to go to her husband Charles Frederick Withell. In the event of him predeceasing her, the legacy to Dorothy Easton should remain, but the beneficiary of the remainder of her estate was her brother-in -law George Henry Withell.
A Codicil dated 22 December 1955 added after the death of her husband, revoked the previous legacy to Dorothy Easton and replaced that clause with the consideration of all moneys in her name in the South Devon Trustee Savings Bank at the time of her death.
A second Codicil dated 29 November 1957 was added following the death of her brother -in -law George Henry Withell. One hundred pounds was to be divided amongst the staff of the Lelant Nursing Home where she was living provided she had remained there until her death.
