MARTYN WITHELL (1733-1807) TO BE UPDATED

Martin Withell was christened in the parish church of St. Eval near Padstow, Cornwall on the 13th of July 1733, the sixth year of the reign of King George the Second. Although he was the fourth child born to Martin Withell Senior and Mary Withell (nee Dawbins) he was the first son. It would appear that as he grew to manhood the young Martin's behaviour and particularly his attitude to work displeased his father. When Martin senior made his last will on 24 December 1760, the two other surviving siblings were very well provided for. Instead of being the heir, Martin was left one shilling and provision for food and clothing so long as he lived with his younger brother and behaved himself in a careful working manner. It would have been a very unhappy situation for a young man of 27 to be subservient to a sixteen year old brother and the bitterness established between Martin and his spinster sister Mary was also to continue.

On 28 July 1763, when he was about thirty, Martin and Elizabeth
Ivey were married by licence in her home parish of St. Merryn. Both bride and groom were able to sign their name. The vicar was Rev. John Gurney and the marriage was witnessed by JohnTreverton and Stephen Ivey. The licence was probably necessary because Elizabeth was well advanced in pregnancy.
Elizabeth who was age ? at her marriage, was the daughter of ?//
and was probably a steadying influence on Martin. Was there any dowry or inheritance from the Ivey family???

Although the Prideaux family papers relating to Padstow manor record land at Trevone in 1786 as "late Withiells" and in 1787 rates were paid on a Padstow property, Martin was apparently unable in the first years of his marriage to provide a permanent home. The record of baptisms indicates the lack of stability associated with several changes of residence.

The first child, a third generation Martin, was baptised at St. Ervan on 30 October 1763. There is a gap in the surviving records of family baptisms of the next four years but a family tombstone at St. Merryn confirms that Martin had a brother John who was buried on 8 April 1796. John could have been born during this time.

The family returned to St. Merryn perhaps to stay with Elizabeth's parents for the birth of two daughters, Mary and Elizabeth but by 1772 Martin and his family had returned temporarily to his home parish of St Eval. The baptisms of Roger, William and Samuel were recorded in the St Eval Parish register. Again the family apparently moved, because the two youngest sons were baptised in the parish church of St. Ervan. Thomas was born 11 September 1778 and Robert born 27 May 1781 .

On 12 December 1781, Martin's younger brother John Withell age 37 died at St Eval and was buried at St Merryn. The tombstone inscription placed in the churchyard at St. Merryn in his memory describes a man of honest, noble and heroic mind, possessed of such good qualities that he was loved by all. He was paid tribute as a dutiful son, loving brother and a sincere and faithful friend. Although John was apparently unmarried, his death does not appear to have benefited Martin. Their mother and surviving sister remained at St. Eval and some of the leaseholds seem to have been surrendered . Certainly the estate at Trevone is listed as "late Withiel's estate" from this time.

As Martin and Elizabeth now had seven sons requiring to make an independant living, the family moved into the town of Padstow.

Talk about life in Padstow

By the date of his death in 1807, Martin had acquired leasehold of land at St. Minver but ????check book on St Eval etc ref state of farming at this time

Martin's mother Mary Dawbins died on the 12th of April 1796 and left all her possessions to her spinster daughter Mary Withell, the only one of her children surviving apart from Martin. Martin was apparently very displeased at his mother's action which had presumeably been undertaken to ensure her daughters financial future. Martin's response was to place a caveat on the administration of his mothers will. This then led to a series of hearings before the consistory court at Exeter during which Martin was required to show just cause why probate could not be granted. Although no record of the judgement in the case seems to have survived, it is probable that Mary Withell was the victor because at the time of her own death four years later she left an estate which came under the jurisdiction of the prerogative court of Canterbury. For this to happen, her property must have been either of great value or distributed over more than one county. It is probably more likely that the latter is the case because the Dawbins family from whom her mother was descended came from the parish of St. Stephen by Saltash, hard against the Devon border. Therefore as a beneficiary of some of the Dawbins property, her mother's holdings may not have been limited to Cornwall.

Martin Withell describes himself in his will of 1804 as a Yeoman and at the time had leasehold of land in the fields and hamlets of Fredrisick in the Parish of St. Minver. As no inventory was taken at the time of his death, it is impossible to exactly estimate his wealth but it is worth noting that in his will he provided his wife with an annuity of fifteen pounds, a considerable sum at that period. At the time of his death in 1807, at the age of seventy-four, Martin lived in the town of Padstow. He was buried in the graveyard of the Parish of St. Merryn on the 27th of September, 1807. His wife lived only two more years and was buried at St. Merryn on the 25th of
February 1809. Martin was born before 13 July 1733 at St Eval, Cornwall, England.

Martyn Withell jnr. was churchwarden between 1757 and 1759 This was before his marriage to Elizabeth indicating he was living in St Eval, probably with his parents.CHECK IF is the son. Would be more likely the father who was still alive.1

He married Elizabeth Ivey on 28 July 1763 at St Merryn, Cornwall, England. Martin Withiel of St.Eval and Elizabeth Ivey of this parish were married this twenty eighth day of July 1763 by me John Gurney by licence.
Signed Martin Withiell and Elizabeth Ivey
Witnessed and signed John Treverton and Stephen Ivey

It has been suggested that the Elizabeth Ivey who married Martin Withell may have been an older Elizabeth, daughter of John Ivey and Martha Growden and bap 13 October 1732. However the witness was a Stephen Ivey who was probably either her father or her brother. There was not a Stephen Ivey in the family of John Ivey..2

In about 1786 Martin and Elizabeth left Trevone and moved with their family into the township of Padstow. Martin had been bypassed for a large part of what could have been his inheritance and they had a large family, all of whom survived to adulthood. There would not have been work for the sons on the relatively small holding at Trevone.

Martin opposed the claim of Mary Withell on 23 September 1796 Episcal Consistory Court of Exet at Cathedral, Exeter, Devon, England. M2.3 He made a will on 22 September 1804 at Padstow, Cornwall, England. BY PERMISSION OF ALMIGHTY GOD,
I, Martin Withell the Elder, of the town of Padstow in the County of Cornwall, Yeoman, being but weak in body but of sound, perfect and disposing mind, memory and understanding, thanks therefore be given to God for the same, and as touching the disposition of all my worldly effects in which it hath pleased God to bestow upon one, do make and publish this my last will and testament in manner and form following.
(THAT IS TO SAY).....

FIRST     I devise that my body be decently buried by the direction or order of my executors and executrix's hereinafter mentioned. I give and bequeath unto my dear wife Elizabeth, her executors, administrators and assigns all that my household furniture of every description whatsoever that I am possessed of at the time of my decease.

I give and bequeath unto my son Martin Withell one shilling as soon as convenient after my death.

I give and bequeath unto my several children (namely) Betsy, Roger, William, Samuel, Thomas and Robert and to each of them their executors, administrators and assigns, all that my leasehold messuage (dwelling house with outbuildings and land) tenement with its appertenances, situate, lying and being in the village fields or hamlets of Fredrisick in the Parish of Saint Minver, in the County of Cornwall, share and share alike, during the continuance of the lease, together with all other my effects not before bequeathed.

They my said children or some or one of them paying out of the same premises unto my said wife Elizabeth the sum of fifteen pounds per year during her natural life if the lease of the same premises should so long continue, the same to be paid in equal quarterly payments if my said wife thinks fit and convenient to demand it.

Also allowing to my son Robert out of the incomes or produce of the said premises sufficient wearing apparel, medicine and other neccessaries in the same manner as hereftofore have been allowed him during the remainder of his apprenticeship.

LASTLY I do hereby nominate, constitute and appoint my said several children, Mary, Betsy, Roger, William, Samuel, Thomas and Robert Executrix's and Executors of this my last will and Testament revoking, disannulling and making void all former and other will or wills by me heretofore made.

Roger was born before 4 January 1772 at St Eval, Cornwall, England.

His childhood seems to have been spent between St Eval and St Ervan but by the time he was 15 the family had moved into the town of Padstow. The shipyards in Padstow were flourishing and Roger was trained as a shipwright, probably in the shipyard owned by his older brother Martin. It is possible that he also found employment as a seaman or ship's carpenter for a time and perhaps travelled to London.

He married Mary (?). We don't know anything about Mary prior to her marriage to Roger but she was not born in Cornwall nor was the marriage recorded in Padstow. It is possible that they were married in London although no record has been found. Whatever the circumstances of his visit to London, it was there that the baptism of the first child by his marriage to Mary was to be celebrated..

Following the baptism of Sarah Elizabeth, Roger and Mary returned to Padstow where ten more children were born. Only three daughters and two sons were to survive into adulthood. Roger Withell lived Note ref. rates and residence. CHECK.

A census listed Roger as head of household on 6 June 1841 living in South Quay Alley. at Padstow, Cornwall, England. His occupation was Shipwright. Mary was not at home but his grandson Thomas Parsons and his daughter-in-law Malind Ann and her 4 months old son Thomas Henry were also in the home.1

Following her marriage Mary had moved to Little Petherick where William would have been working. It appears that she may not have taken her 5 year old son Thomas Parsons with her because when the census was taken on 6 June 1841 Thomas was staying with her ex father-inlaw Roger Withell in Padstow. Thomas married Malinda Ann on 28 May 1839 in the parish church at Fowey, Cornwall, England. A witness at the marriage was Henry Cossentine whose daughter was later to marry Nicholas Butson Withell son of Thomas and Emily..1 Thomas was employed at WHERE CHECK THIS as a Shipwright on 6 June 1841.2

The family moved to Wales shortly after the birth of Nicholas and were in Neath when Selena Jane was born. This move was surprising because although work in the shipyards at Padstow had been scarce, the shipyard at the end of East Street owned by the Butsons continued its operation. The 1861 census shows Malinda's brother, Nicholas Butson age 48, employing nine men and three boys and Joseph Butson age 39 employing eighteen men and three boys. Nevertheless both Thomas and his brother Roger Withell moved to Wales.

Roger was accepted as an apprentice shipwright on 4 July 1825 at Padstow, Cornwall, England. The apprenticeship indenture was arranged between George Sloggett, a shipwright with yards in Padstow and Roger Withell senior, father of Roger. It was for a term of 7 years with payment for the first year to be three shillings per week. The weekly wage for the next two years was four shillings and for the remaining four years the rate was five shillings. The document was signed by Roger Withell sen and jun and by George Sloggett..1

Marriage banns for Roger Withell and Eliza Pollard were published on 27 August, 3 and 10 September 1837 at St Petroc, Padstow, Cornwall, England.2 He married Eliza Pollard in the parish church on 12 September 1837 in Padstow. Roger was a shipbuider and son of Roger Withiel shipbuilder and Eliza Pollard, servant, was the daughter of James Pollard deceased. Roger signed with the spelling Withell although the vicar's spelling was Withiel. Witnessed were Thomas Withell and William Kent. Eliza may have been working for the Kent family..3 Roger was issued a ticket to work as a carpenter to be employed by the Maritime board at Swansea, Glamorganshire, Wales, on 11 July 1850. His place of birth was recorded as Padstow and his height was 5'3 1/2".The date of birth given in the transcription is 5 April 1821 in Padstow. If this is a correct transcription it seems likely that Roger may have put his birth date back by 10 years to secure work because there is no record of a Roger born in Padstow in 1821.4 A census listed Roger as head of household on 3 April 1881 20 Vincent St at Swansea, Glamorganshire, Wales. His occupation was Ship Carpenter.5 Roger died before 12 December 1882 Richards Place at Swansea, Glamorganshire, Wales.6 He was buried on 12 December 1882 at Swansea, Glamorganshire, Wales.6
