It is interesting that Thomas's father was probably drowned whilst the children were very young and they were forced to live in a workhouse, and yet he managed to get regular employment and was able to leave a reasonable bequest to his wife. He made a will on 5 December 1949 at Swansea, Glamorganshire, Wales. He bequeathed his leasehold property at 84 Argyle Street to his Trustees on trust for sale and conversion at their discretion to provide income for his wife Frances Mary during her life. The residue of his real and personal estate was given to his wife and after her death to his nephew Thomas Henry Lewis. The trustees were to be his wife and nephew and the witnesses were Harold G.T.      A baptism has not been found for Roger but he was most likely born about 1630 in St Merryn, Cornwall. Six adult Withells took the oath for the Protestation returns in St Merryn church in 1641 and at least three had young families - Roger and Mary Withell, John Withell with his wife Frances Pears and Thomas and Mary Withell..

Although the decline of the Cornish language in the east of the county was more advanced than in mid Cornwall, the language spoken by Roger was most likely English. The records of the Bishops of Exeter give evidence of the need for appointment of Cornish interpreters in mid Cornwall in the late 14th century and in 1339 he granted a licence to preach to John Polmark to help the vicar of St Merryn 'expound the word of God in the said church in the Cornish language'.1,2

Roger was to set up business as a Tanner. As a Tanner he was a man of some substance. There were two methods of tanning and most tanners used both methods. The process of tanning heavy leather from cattle hides was complicated and lengthy, taking up to two years. By contrast the oil dressing and tawing of light leather from thinner hides and skins such as calves, sheep and goats was much simpler taking only a few weeks. Labour costs were low but hides were expensive using capital with no immediate return on the outlay. The inventory of goods and chattels taken on 1st September 1693 after his death, shows that the value of his estate was in the top bracket of Cornish tanners in the second half of the 17th century. Of the estate valued at 160 pounds 2 sh., his stocks of leather were worth 109-19-0 and 30-0-0 was for implements of trade. The average value of estates of tanners was 130-00-00.3

He married Kathren Waren on 22 October 1656 at St Petroc, Padstow, Cornwall, England. This entry has been incorrectly transcribed as John Mitchell in the Phillimore Marriages publication..4

Roger Withell lived on 10 January 1661/62 at Padstow, Cornwall, England, where he held a 14 acre property named Trevone. He was listed several times in the records of Padstow manor as paying yearly rates from seven pounds 17 shiliings and 6 pence up to twenty pounds ten shillings. Roger would have needed to live close to the town of Padstow to give access to the meat markets and a convenient place for sales of leather to the town craftsmen.5 Roger died on 22 July 1693 at Padstow, Cornwall, England.4 He was buried on 23 July 1693 St. Petroc churchyard at Padstow, Cornwall, England. He was buried in Wool.6 An inventory of the goods and chattels of Roger Withell, Taner of the Town of Padstow within the county of Cornwall who died the twenty-second day of July last past, appraised the foirst day of September 1693 by Thomas Trousthon Taner of St Merryn and Thomas Mirkall, Taner of the Town of Padstow as followeth:

Roger did not leave a will but his estate was valued for probate on 3 September 1693 at Padstow, Cornwall, England. The record noting that later Withells had occupied Trevone indicate the possibility that his entitlement and tenancy of Trevone was passed on to his children..7

His son Martyn Withiel Yeoman 1657-1720 increased the financal status of the family by purchase and marriage and soon acquired the status of Yeoman. He became very active in the community

By the time he was 21, he had his own farm and on 1 October 1677 he was presented at the court of the Manor of Padstow Penkival as a new tenant to be sworn and duly admitted. On 8 August 1679 he was appointed to the office of a Reeve for the Manor. He would have then been about 23 years of age and had apparently proved himself to be capable of administration. He served as one of the twelve jurors on the manor court and was appointed jointly with John Gilbert to be "viewers of reparation". This required them to inspect and assess grass. In 1686 Martin was noted as churchwarden for the parish of St Merryn.

When he married Mary Brewer on 1 Jan 1682 at St Merryn, he took possession of the half of New Park with the dwelling house, courtlage, land, and the part of the moor adjoining which Mary had inherited from her father Frances Brewer in his will dated 22nd August 1680. Mary died in 1686 leaving Martin with the care of two young daughters, Mary and Elizabeth who was to marry William Guy.

On 15 September 1688, less than two years later, Martin married Mary Hicks m.n Gill at ST Ervan. Mary was the widow of Clere Hicks who had died in 1684, leaving Mary and a young son George. Mary Hicks died on 25 Jan 1694 and Martin became a widower for the second time, responsible for his four Withell children, and his stepson George Hicks. A sign of his affluence was the large memorial slate was placed in St Merryn churchyard for the two children of Martin Withell, Yeoman who had died in February 1697.

See photo of their tombstone in Journal XXXX

Martin had not achieved the social standing of gentleman but as a yeoman, could aspire to marrying an heiress. His marriage in 1703 to Jane Leigh heiress of John Leigh gent. of Leigh Manor in Week St Mary was probably such an arranged marriage. Jane was descended from Thomas Aleigh of High Leigh in Cheshire who had settled in Cornwall sometime before 1500. She had been given lands in Brendon and Poundstock when her father died in 1683.

Jane who was already 38 had only one child, Martin, who would have been brought up with his half-sisters Elizabeth and Frances and step brother George Hicks. Martin and Jane were to have nearly 20 years together, the wording on Jane’s tombstone suggesting they were very devoted.

Martin continued to acquire land. In 1712 he was involved in a partition of property in Padstow. His eldest daughter Elizabeth had married William Guy of Tredrissick in St Minver in 1706 and in 1718 Martin negotiated a 99 year lease to take over Tredrissick on the lives of his son Martin and grandson John Guy. Tredrissick stayed in the family until the expiry of the lease on the death of his great grandson Thomas Withell in 1846.

Although his will was lost at Exeter in WW II we do know about some of his real estate. He held a 99 year lease for Tredrissick in St Minver, property in Padstow, property in Trevone and perhaps the lands or proceeds thereof which had been given to Jane. The east field of New Park occupied by his stepson George Hicks and his son-in –law Thomas Mitchell was left to his son Martin.

We were fortunate to be given the wording of these tombstones by Mrs Olga Riley because they can no longer be viewed.

The body of Jane the wife of Martin Withell who departed this life the 15th day of March ? 1725/6
Triumphant death thy ---------now lay down
Yield up thy Triumphs which thy Brave has worn
We now in our turn new Triumphs find
For they whom Thou didst part again are joined
Near to each other here we lie at last
No fears possess our souls .

Martin was born say 1657. A baptism has not been found for Martin but the year of birth is estimated from information on his tombstone which gave his age at death in 1720 as 64..1

As he became of age, Martin must have decided to settle on a farm of his own because on 1 October 1677 he was presented at the court of the Manor of Padstow Penkival as a new tenant to be sworn and duly admitted.2 Martin was employed at as a Martin became active in the community at an early age. By the time he was 21, he had his own farm and on 1 October 1677 he was presented at the court of the Manor of Padstow Penkival as a new tenant to be sworn and duly admitted. On 8 August 1679 when he was about 23, he was appointed to the office of a Reeve for the Manor, having apparently proved capable of administration. He served as one of the twelve jurors on the manor court and was appointed jointly with John Gilbert to be "viewers of reparation" responsible for assessment of grass. In 1686 he was noted as churchwarden for the parish of St Merryn. at Manor of Padstow Penkivel, Cornwall, England, on 8 August 1679.2 Although there is no record of an actual marriage settlement, Martin took possession of the part of New Park which Mary had been given by her father in his will dated 22nd August 1680. This was to be subject to a dispute with her brother Stephen in 1721.

He married Mary Brewer on 1 January 1682 The entry in the Register records that Martin Withell son of Roger Withell married Mary daughter of Francis Brewer. at thr parish church, St Merryn, Cornwall, England.3

In 1686 Martin and John Trevethen were noted as churchwardens for the parish of St Merryn.3 Martin Withell of St Merryn was was levied rates of 6d (sixpence): and Martiyn Withell for Jane (custises tenement) 2d (twopwnce) in 1688 at St Merryn, Cornwall, England.4

Martin Withell of St Merryn married Mary Gill Hicks on 15 September 1688 at St Ervan, Cornwall, England, The register entry records that Martin Withell of the parish of St Merryn and Mary Hix of St Ervan were married on 15 September 1688. Her first husband Clere Hicks had died in 1684, leaving her with a young son George.5

Martin Withell of St Merryn married Jane Leigh, daughter of John Leigh gent and Jane Couch, on 17 July 1703 at Week St Mary, Cornwall, England. Martin had been a widower for nearly 10 years and was about 42 years old and Jane was 38. Jane had a considerable inheritance, both in money and for her properties in Brendon and Poundstock which doubtless Martin would have been able to access.

Martin Withell of St Merryn signed a Land Contract on 16 June 1712 at Padstow, Cornwall, England, A deed of partition was prepared on behalf of Hon. Mary Teresa Leach of Lane, Devon, widow and Edmund Prideaux of Padstow, esq. and Susanna his wife to divide a property in Padstow between the following:
Jonathan Peter of St. Merryn, gent. et al.
Richard Vivyan of St. Issey
Martyn Withell of St. Merryn
Petherick Gilbert of Padstow, chandler
William Ivey of St. Merryn, yeoman
Robert Trevithuan of Padstow, yeoman
John Biddick, junior of St. Issey
John Biddick the father of St. Issey, cordwainer
Samuel Trevithuan of Padstow, carpenter.6

He made a will before 1 February 1721 at St Merryn, Cornwall, England. Because this will was destroyed at Exeter in 1942, the beneficiaries and the extent of their inheritance is not known but a petition made by Stephen Brewer shortly after Martin's death indicates that his son Martin and perhaps his stepson George Hicks and daughter Frances Mitchell were heirs.
He appears to have acquired or taken possession of several properties, some of which were the subject of litigation - New Park, Trevone, Lands in Tredrissick and some property in Padstow. He would also have had access to the assets of his third wife, Jane Leigh, both in money and for her properties in Brendon and Poundstock..7,8

Martin died suddenly on 1 February 1720/21 at St Merryn, Cornwall, England.9,1 He was buried on 2 February 1720/21 Churchyard at St Merryn, Cornwall, England. The parish register records - Martin Withiel sen. buried..
