If not a firm of solicitors was appointed as trustee and the beneficiaries were to be Charles Burt, Sarah Beatrix Burt, Catherine Alexandra Burt of 11A Fontnell Park Ashford and Maxwell John Withell of 18 Bourke St Wollongong.2 John died at age 78 on 2 April 1984 at Plymouth, Devon, England.3 John's will was probated on 30 April 1984 at Bristol, Somerset, England.4

There is no Birth entry for Mabel Withell at correct date so presume there will be a birth entry for Mabel Curtis. Mabel was born on 15 October 1876.1 She married Arthur Henry Withell in September 1900 at Portsmouth, Hampshire, England.2 Mabel died at age 93 in September 1970 at Redbridge, London, England.

     He was baptized on 25 July 1835 in the parish church of St Petroc at St Petroc, Padstow, Cornwall, England.1 Following the death of his father, his mother married William Bullen and moved to Little Petherick, and it seems that Thomas remained in Padstow with his Withell grandfather. He married Ellen Brabyn on 11 September 1855 at Padstow, Cornwall, England. Thomas was married as Thomas Withell Parsons, a shipwright age 20 and son of Joseph Parsons Sailor. Ellen was a spinster aged 19, Tailoress, daughter of William Brabyn. Both Ellen and Thomas signed, although Thomas may not have been used to using the Parsons surname because it appears to have been added separately. The witnesses were Henry Brinton and Henry Harden..1

Following their marriage Thomas Henry Withell Parsons and Ellen Brabyn lived in 1857 at Padstow, Cornwall, England, where they were paying rates on a house they had leased. (Details to be checked from 1991 notes.)

Thomas Henry Withell Parsons signed up as a ship's carpenter on the Capricorn on 6 July 1865 at Swansea, Glamorganshire, Wales, He gave his birth as at Padstow in 1837. He had previously sailed on the Patagonia. The Capricorn was to sail from Swansea on 10 July 1865 bound for Chile via Cape Horn, arriving in Valparaisa on 28 October 1865. It remained there until 18 November before proceeding on to Coquimbo and Caldera, returning to Swansea on 16 April 1866 after a voyage of 9 months.2

He married Elizabeth Jane Cowling on 3 March 1867in the Wesleyan Chapel at Camelford, Cornwall, England. Thomas gave his name as Thomas Henry Withell son of Thomas Henry Withell mariner (deceased) and Elizabeth Jane was the daughter of Thomas Cowling mariner. It is interesting that one of the witnesses was a Thomas KENT- but a witness to the marriage of Roger Withell and Eliza in Padstow was William KENT and in 1860 Eliza Withell was allegedly "formerly KENT", not Pollard as expected.

It appears that Thomas's first wife was still alive at this time, making this a bigampus marriage, perhaps as a result of Elizabeth Cowling being already pregnant with her first child. His first wife Ellen Brabyn also remarried, indicating a second bigamous marriage. This has been confirmed by an inspection of the original records and comparison of signatures carried out by the registrar at the local Registry Office.3 Thomas died before 4 July 1876 presumed drowned at HMS Herradura, at sea. He had been a member of the crew of the Herradura (Ship No. 44492) which had been missing since 4.7.1876. Thomas was a carpenter age 38 and his birthplace was given as Padstow, Cornwall. His address before signing up was 36 Little Madve Street, Swansea. Cause of death was supposed drowned.

John Withell1

     John was named after his grandfather, John Withell. He was a batchelor for most of his life, living with his parents at 50 Russell St. Halifax Novia Scotia. After his father's death in 1910, he continued to live in the family home. His sister Edith may have still been there.

When he was ? years old, he married Ellen Evelyn Mason the family housekeeper who was 50 years old. The wedding took place on 26 August 1915 in Halifax and was a first marriage for both.

John was a machinist and always worked for the I.C. Railways. He and Ellen were able to use his entitlement of free rail passes to visit his neice Margaret in Montreal. The family remember the visits and the old fashioned clothes the couple wore.

The home at 50 Russell St was destroyed in the Great Halifax explosion which occured at 9:00 am on December 1917. John and Ellen survived. As part of the Government resettlement scheme the house was replaced and the family continued to live there until John's death in 1944.

Ellen died on 11 June 1942 at age 77 and was buried in Camp Hill cemetery. John died on 8 March 1944 aged 86 and was buried with his wife. His entire estate valued at just under $5000 was left to his niece Margaret (Miller) Clapham. John was born on 4 November 1858 at St John's, Newfoundland, Canada.1 He married Ellen Evelyn Mason on 26 August 1915 at Halifax, Nova Scotia, Canada. John Withell was employed by Department of Railways and Canals as a machinist. This appears to have been an announcement of an award of some kind. in 1924 at Halifax, Nova Scotia, Canada.2 John died at age 85 on 8 March 1944 at Halifax, Nova Scotia, Canada.

Mary was born on 6 July 1875 at Halifax, Nova Scotia, Canada. Mary died at age 33 Epilepsy on 9 April 1909 at Halifax, Nova Scotia, Canada.

     Edith Withell never married. She died in the Arcadia Nursing Home, Beaverbank N.S. aged 93 and was buried in her brother John's grave at Camp Hill Cemetery. Nothing is known of her after 1901 when she was listed as living at 50 Russell St with her father, brother and sister Bessie. No one of the generation of Nancy Tabbiner even knew she existed.

Her neice Margaret Clapham made the funeral arrangements and the obituary in the Presbyterian newspaper states that Edith was survived by her only neice Margaret. In fact she had three neices and a nephew still living.

It is possible that Edith was institutionalized from the time her father died or even earlier. There must have been a reason why only one niece knew of her. Edith was born on 25 May 1877 at Halifax, Nova Scotia, Canada. Edith died at age 91 on 8 July 1968 at Halifax, Nova Scotia, Canada.
