Henry Peter was buried on 18 September 1821 at St Merryn, Cornwall, England; In the vault of this church lie interred the mortal remains of Henry Peter, late of Harlyn, in the county of Cornwall, Esquire, whose memory is deservedly esteemed by all who were acquainted with his life. Just, liberal, benevolent, humane, a determined enemy to every species of corruption, intolerance, and oppression: a zealous friend to the freedom and interests of mankind. He exhibited in the discharge of his magisterial and public, no less than of his domestic and social duties,- a happy union of those virtues which commanded the respect and conciliate the affections of wise and good men.
He was born on the 30th January 1753; was married on the 24th June 1782, to Anna Maria, youngest daughter of Thomas Rous, Esqr. Of Pearcefield, in the county of Monmouth; and died on the 18th September, 1821. An example of Christian Charity and beneficence to all; and to his family, his friends, his neighbours, and his dependants, an object of unaffected love, esteem, and regret.
Henry died at age 68 on 18 September 1821 at St Merryn, Cornwall, England.

The baptism entry states that John was the son of John Peters gent lately deceased and Elizabeth his wife..1,2 Any further detail regarding this John has not been so far found. However there was a Mr John Peter of Padstow, gent., living between 1762 and 1766 whose identification is not yet confirmed.
This John Peter purchased two leases in St Cadock in conjunction with Rev. Charles Guy of Padstow, clerk. The first dated 26 October from Rt. Cotton Trefusis of Trefusis, esq. was for fields and stitches on Trewollas alias St. Cadock (named), inc. a ridge over St. John's Well.
A second lease being for 1/8a inc. St. Cadox, was purchased from Sir John St. Aubyn of Clowance on 19 December 1762 for £30. The term was for 99 years on the life for £30 on the lives of Ann (17) dau. of John Symons of Padstow, dec. and John Hoblyn of Padstow, gent. (23) and Ann (13) dau. of John Hetherinton of Padstow.
On 19 Dec. 1766 John Peter and Rev Charles Guy assigned the title deeds for Hitches on St. Cadox to Ann Symons of Padstow, spinster (mentions over St. Johns Well a ridge or piece of ground half or quarter an acre).
Ann apparently married John Hoblyn of Padstow because on 22 May 1812 a large assignment of land in St Cadock was made as follows:-

     Thomas was born before 23 March 1726 at Padstow, Cornwall, England.1 Thomas was an apprentice in 1744 at Falmouth, Cornwall, England.2 On the death of his father William Peter, Thomas was the eldest surviving son and inherited his father's estate. This included Treator, Trenyow, Trevone and Trevance which were part of the marriage settlement for his fatrher and Jane Martin and subject to an entail primarily in the male line.3 He lived in 1784 at Padstow, Cornwall, England; Doctor Peter and Mr Martyn were listed as paying High Rent to Humphrey Prideaux for a House in Berry Lane Street. Doctor Peter also occupied a house in Church Street.4 On 5 December 1788 Thos Peter of Padstow, surgeon signed a reversionary lease for 99 yrs. or 2 lives with Darell Trelawny of Coldrinick esq. on a messuage and tenement in Tredissick which in possession of Mrs. Jane Kent, then of Thomas Peter. The considerastion was £150 + 2 guineas to Mrs. Trelawny plus rent 12s., a capon or 1s. at Xmas and a Harvest Journey or 6d. The Heriot was set at £1. Rights to timber and saplings was reserved and all minerals. The term was for the lives of Susanna Peter (52) dtr. of Wm. Peter and Chas. Peter (14) son of Thos. Peter of Endellion and to begin on death of Jane Peter. The leaseholder was to attend to repair. Re-entry was alowable after arrears of 6 months in default of distress, or decay to value of £4 not repaired after 6 months notice, or act(s) prejudicial to the Trelawny estate. Witnesses were W. Moorman jun., George Raw.5 He was unmarried in 1791. He made a will on 14 June 1791 at Treator, Padstow, Cornwall, England. He appointed Henry Vyvyan of Withiel clerk and Charles kent of St Minver Gent as trustees.The main beneficiary was his cousin Charles Peter, his nearest surviving relative in the male line. Charles was to inherit all the properties comprised in the marriage settlement of his parents, the terms of which Thomas confirmed. He also gave Charles properties called Treglyn, Will's ground, the Wem's, Gunvena and Arundel Downs in St Minver and properties in Trelowsa and Padstow except Cock's house. This was to be given to his sisters, Anna and Susanna Peter, but after the death of both sisters it was also to be given to Charles Peter. Anna and Susanna Peter were also to receive any ready money form his house at the time of his death and money due from other sources at this date, with interest due. They were to take whatever of his Plate China and Household furniture and utensils as they wished. His sister Jane Kent widow was given all the furniture from the house at Treglyn. Several smaller bequests were made to relatives. All the children of Henry Peter esq, except the eldest were to receive One hundred pounds when they reached twenty-one. His God daughter Sarah Peter spinster was to be given ten pounds at the end of six months after his death and the widow of Thomas Peter was to receive ten pounds yearly for the term of her natural life by half yearly payments. His trustees were to give his sister Rebecca Kendall twenty pounds yearly for her sole benefit and use and to be without the control of her husband. Small bequests were made to John Kent of Trefeeza, four Martin brothers and to servants. Provision was made to place Walter Martyn, son of Malachi Martyn as apprentice to a trade. The residual legatees were to be his three sisters. Interesting to note that John Withell was one of the witnesses; Will made 14 June 1791.     
This is the last will and testament of me Thomas Peter of Treator within the Parish of Padstow in the County of Cornwall Esquire Revoking and making null and void all former wills by me heretofore made

First - I HEREBY give and devise and bequeath unto Charles Peter Son of Thomas Peter late of the Parish of Endellion Gent: deceased and to his Heirs all such messuages lands Tenements Hereditaments and premises as are comprised in the settlement made on the marriage of my Father and Mother deceased and I do hereby as far as in me lies ratify and confirm the said marriage settlement and every part thereof-
ALSO I hereby give devise and bequeath to Henry Vyvyan of Withiel clerk and Charles Kent of St Minver Gent: and to the survivors of them and the heirs of such survivor All these my messuages Lands and Tenements called Treglynn Wills's ground the Wemms?     Gunvenna and Arundell's Downs with their and every of their appurtenances situate in the aforesaid parish of St Minver And also all that Messuage and Tenements called Trelowsa and all other messuages lands and tenements situate either in the Town or Parish of Padstow aforesaid/ except Cocks House in the town of Padstow/ with their and every of their rights members and appurts TO HOLD the several and respective premises aforesaid IN TRUST and for the only use and benefit of the afsd Chas Peter and the Heirs Male of his body lawfully issuing but in default of such issue then and in such case I hereby devise and bequeath the aforesaid premises and every part and parcel thereof unto Henry Peter of Harlyn Esq.re his Heirs and Assigns forever
Also I give devise and bequeath unto my two sisters Anna and Susanna Peter and to the survivor of them and the assigns of such survivor All that my messuage and Tenement called Cocks House situate within the town of Padstow aforesaid with the several and respective appurtenances thereunto belonging, but from and after the death of the survivor of them I give and devise the said House and premises unto the aforesaid Chas Peter and his Heirs forever-
ALSO I HEREBY give devise and bequeath unto the said Henry Vyvyan and Chas Kent and to the survivor of them and the Exors and Admon of such Survivor All my leasehold Estates whether determinable on live or otherwise
IN TRUST and to and for the sole use benefit and advantage of the said Chas Peter his Executors Administrators and assigns for and during all the rest residue and Remr of the several Terms therein- ?? yet to come & unexpired
ALSO I give and bequeath unto my sisters Anna and Susanna Peter their Executors and administrators all such ready money as I shall have in my House Custody and possession at the time of my death and all moneys that now are or hereafter may be due and owing to me on mortgages Judgments Bonds Notes or on any other account whatsoever with all such Interest as may be due on the same respectively at the time of my death
ALSO I give and bequeath unto my said sisters Anna and Susanna Peter so much of my Plate China and Household furniture and utensils of every sort and denomination as they shall think proper to take and choose and I hereby give them the same as their own property and goods and chattels forever.
ALSO I give and bequeath unto my sister Jane Kent Widow all and every part of the furniture of my house at Treglyn within the parish of St Minver afs.
ALSO I give and bequeath unto the said Henry Vyvyan and Charles Kent and the survivor of them and his Exors and Admors the sum of One Hundred pounds to be equally divided between all the children of Henry Peter Esq:/ Except the eldest son who is to have no part thereof when they shall severally attain their Ages of 21 years.
ALSO I give to my God daughter Sarah Peter Spr the sum of Ten pounds to be paid her at the end of Six months after my decease-
ALSO I give and bequeath unto      Peter the widow of the aforesaid Thomas Peter and Mother of the aforsaid Chas Peter the clear sum of Ten pounds yearly and every year for and during the Term of her natural life to be paid her by half yearly payments the time to commence and be computed from the day of my death and I do hereby subject and make liable all my Messuages Lands and Tenements to the payment of the same
ALSO I give and bequeath unto the said Henry Vyvyan and Chas Kent and to the survivor of them his Executors Admons the clear yearly annuity of Twenty pounds to and for the sole use and benefit of Rebecca (now the wife of Clement or Walter Kendall) the sister of the afsd Chas Peter And it is my express will and desire that the same shall not be subject or liable to the debts or contoul of her present or any other after taken husband but for her sole benefit and her receipt from time to time and at all time shall be sufficient discharge to my said trustees or either of them for the same time to commence from the day of my death and I do hereby subject and make liable all my Estates to the payment of the same
ALSO I give and bequeath unto John Kent of Trefeeza in St Minver the sum of Five Guineas to be paid him at the end of three months after my death
ALSO I give and bequeath unto my servant John Rounsevall the clear yearly annuity of Eight pounds to be paid him by half yearly payments during the Term of his natural life, to commence from the day of my death and I do hereby subject and make liable all my Estates to the payment of the same Also I give unto my servant George Row the sum of Ten pounds to be paid him at the end of three months after my death Also so I give to Malachi, Robert , James and Charles Martyn four brothers the sum of five pounds to each and every of them, to be paid at the end of three months after my death-
ALSO to all and every of my other servants both at Treator and Treglynn I give three Guineas to each of them to be paid to them respectively at the end of three months after my death
ALSO I give to Walter Martyn son of Malachi Martyn the sum of Ten Guineas to be paid to put him an apprentice to some trade-
LASTLY All the Rest residue and remainder of my goods chattels personal and Testamentary Estate and effects whats not already given or disposed of, I hereby give and bequeath unto my three sisters Jane Kent Anna Peter and Susanna Peter equally to be divided between them share and share alike and I do hereby make & appoint them Executrix's and residuary Legatees of this my last will and testament and it is my will and direction that all the aforesaid pecuniary legacies shall be paid out of the Residium of my personal Estate, given to my aforesaid Executrix's-Also I give unto the afd Henry Vyvyan and Chas Kent the sum of five Guineas each for the trouble they may be at in & about the Execution of this my Will

Whereas I Thomas Peter of Treator in the County of Cornwall Esqr Have in and by my last will and testament bearing the date the fourteenth day of June last past- Given and bequeathed to my God Daughter Sarah Peter Spinster the sum of Ten pounds, now I do hereby totally revoke the said bequest of 10 pounds & I do hereby give her the sum of five pounds only And I also give and bequeath to my God Daughter Anna Maria Peter the daughter of the said Henry Peter Esq: the Sum of five pounds to be paid at the end of Six months after my decease
Also Wherein I have by my said Will Given to      Peter the Widow of Thos Peter Gent deced the clear yearly Sum of Ten pounds during her natural life Now I do hereby declare that the same shall be null and void and be no longer paid to her in case she shall marry again and payment thereof to cease immediately on such her marriage. And I also Give ands bequeath to the aforesaid Henry Vivyan and Chas Kent & to the survivors of them and to the Executors and Admors of such survivor the sum of Two Hundred Pounds for the use and benefit of Rebecca wife of the said Walter Kendall, and her children to be equally divided between them to be paid by the said Henry Peter Esq: and his Heirs out of the several Estates devised to him, within three months after he & they shall be in possession thereof by virtue of all the devises and limitations contained in my Said Will -
Also I give and bequeath to Catharine Hambly Widow and Susanna Kent Spr her sister the Sum of five pounds each, to be paid them at the end of Six months after my death.
Also Whereas I have given my servant John Rounsevall the clear annuity of eight pounds yearly during his natural life Now I do hereby declare the same null and Void and do only give him the clear yearly annuity of five pounds yearly during his natural life to be paid and secured to him in the manner as directed by my will-
Also I hereby revoke the bequest of Ten pounds Given to George Row by my will and do hereby only give him the sum of Seven pounds to be paid him at the end of three months after my death
Also I hereby revoke the bequeats to Robert, James, and Chas Martyn of five pounds each & instead thereof I only give them the Sum of four pounds each to be paid at the time mentioned in my will
Also I hereby revoke the bequests of three guineas to each of my servants at Treator and Treglynn & only give to each of them at the places afsd. the Sum of One guinea each to be paid as directed by my will.

He wrote a codicil on 16 July 1791 at Padstow, Cornwall, England,A number of bequests were revoked and modified. His God daughter Sarah Peter spinster was to recieve only five pounds and his God daughter Anna Maria Peter dr of Henry Peter likewise five pounds. The bequest to the widow of Thomas Peter was to be null and void if she remarried. The money now allowed in trust for Rebecca Kendall was increased to Two hundred pounds to be divided equally between her children and paid from the several estates devised to Henry Peter Esq. within three months of him taking possession. (This appears to be only applicable if Charles Peter had no male heirs). Catherine Hambly widow and her sister Susanna Kent were to receive five pounds. The amount of the remainder of the bequests were reduced and Ann Best widow and her son John were added to the list. In this document Mary Withell was a witness; CODICIL to the Will of THOMAS PETER
